GYMA-NATHI AEROBICS CLUB provides in-person aerobics, fitness and wellness programmes. Membership may be purchased on a month-to-month basis or as a longer fixed-term package.
Membership gives the member access to the classes and activities included in the selected package, subject to the applicable start date, class timetable, venue capacity, Club rules and instructor guidance.
The Club does not sell or deliver physical goods through the website unless this is expressly stated for a particular purchase.
The applicable membership fee, package duration, taxes and any other charge will be displayed before payment is completed. Payments made through the website are processed securely through PayFast or another payment method shown at checkout.
The member must provide accurate payment and contact information. A transaction is not complete until payment has been successfully authorised and confirmed.
Membership is normally activated within one to two hours after successful payment confirmation.
Confirmation may be sent by email, WhatsApp or another contact method supplied by the member. The confirmation may include the membership start date, selected package, class information and any instructions needed to attend.

Members are responsible for attending classes at the published or communicated times. Failure to attend a class does not, by itself, constitute non-delivery and does not automatically qualify the member for a refund.
Where a member requests immediate activation, the member expressly asks the Club to begin supplying the service within one to two hours. Any statutory cooling-off or cancellation rights that still apply remain unaffected.
Membership fees are generally non-refundable after the membership has been activated or the member has begun using the services, except where a refund is required by law or approved by Club management.
A refund request must be submitted in writing by email, through the website contact form, or by WhatsApp to 063 922 0745. The request should include:
An approved refund will not exceed the original amount paid. Refunds will be processed through the original payment method where reasonably possible. A card refund will be returned to the same card used for the original transaction.
The Club will process a refund within the period required by applicable law and, in any event, no later than 30 days after the refund becomes due or is approved. The time taken for the funds to reflect may depend on PayFast, the member's bank or the relevant payment provider.
Where only part of a service remains unused, any refund or credit may be reduced by the value of services already supplied and any reasonable cancellation charge permitted by law.
A month-to-month member who wishes to cancel must give the Club at least 30 calendar days' written notice.

The cancellation takes effect after the notice period. Fees and other amounts due up to the effective cancellation date remain payable. No further recurring membership fees will be charged after the cancellation takes effect.
A member may cancel a fixed-term membership package before its expiry by giving the Club 20 business days' written or otherwise recorded notice, where the Consumer Protection Act applies.
The member remains responsible for amounts owed up to the effective cancellation date. The Club may apply a reasonable cancellation charge that takes account of services already provided, discounts granted for the longer package and other factors permitted by law. Any amount belonging to the member after lawful deductions will be credited or refunded.
At the end of a fixed-term package, the membership will end or continue on a month-to-month basis only as permitted by applicable law and after the required expiry notice has been given.
Where an online transaction qualifies for a statutory cooling-off period, the member may exercise that right in the manner and time allowed by applicable law.
For online services, a seven-day cooling-off right may apply from the date the agreement is concluded. However, this right may not apply where the service begins with the member's consent before the end of that seven-day period. Transactions arising from direct marketing may also carry separate statutory cancellation rights.
Nothing in these Terms and Conditions excludes or limits a consumer right that cannot lawfully be excluded.
The Club may reasonably change, postpone or cancel a class because of instructor availability, venue restrictions, safety concerns, public holidays, low attendance or circumstances beyond the Club's reasonable control.
Where reasonably possible, affected members will be notified by email, WhatsApp or another available contact method. Depending on the circumstances, the Club may provide a replacement class, membership credit, extension or appropriate refund.
A member should contact the Club promptly if:
The Club will investigate using the transaction reference and may liaise with PayFast or the relevant payment provider.
Members must follow all reasonable Club rules and instructor directions, wear suitable exercise clothing and footwear, disclose any relevant health concern or injury before participating, respect other members and take reasonable care of Club facilities and equipment.
Membership may be suspended or terminated for serious or repeated misconduct, non-payment, unsafe behaviour or material breach of these Terms and Conditions, subject to applicable law.
Members are responsible for determining whether they are medically fit to participate and should obtain professional medical advice where they have a health concern. Exercise carries an inherent risk of injury. Nothing in these Terms excludes liability where exclusion is prohibited by law, including liability arising from gross negligence or unlawful conduct.
A complaint should first be submitted to the Club using the contact details below. The Club will review the matter and respond within a reasonable period. This does not prevent a member from using any remedy available under applicable South African law.
The Club may update these Terms and Conditions from time to time. The version displayed on the website will apply to new purchases from its effective date. Material changes affecting an existing membership will be communicated where required by law.
